What Documents Does Your Child Need Once They Turn 18?

Hey there, this is Emily Hicks, your estate planning attorney in Ponta Vedra Beach. A common question that I get from a lot of parents, especially this time of year is what do my kids need when they go away to college?

So if you haven't thought about this already, don't worry. When kids turn 18, as you know, they are now adults. They may not feel like adults, but they are. And along with that comes your limitation of access to their medical records and to their, you know, financial transactions because they are now adults.

So what we do to provide that solution is what we call our college kid package, which is when someone's getting ready to go to college or maybe they're not even going to college, they're just moving out...they've turned 18.

1. We need to get a power of attorney in place for them so that you can be the first person to help them if they are incapacitated and can't make decisions for themselves.
2. We need to have a health care surrogate where hopefully the parents are nominated as the surrogates to take care of any medical decisions on their behalf again if they are incapacitated.
3. And then also a HIPAA authorization. So, One of the limitations with medical, even making a doctor's appointment for someone is no longer allowed. So we have a HIPAA authorization in place so that you will be able to get medical information about them, if something were to happen.

So make sure you get all of these things in place once your kid turns 18.
